認知の訴の特例に関する法律
１
今次の戦争において、戦地若しくはこれに準ずる地域に臨み、若しくは国外において未復員中その他これらと同様の実情にあつて死亡し、又は国内において空襲その他戦争に因る災害のため死亡した者について、子、その直系卑属又はこれらの者の法定代理人が認知の訴を提起する場合には、民法（昭和二十二年法律第二百二十二号）第七百八十七条但書の規定にかかわらず、死亡の事実を知つた日から三年以内にこれをすることができる。
但し、死亡の日から十年を経過したときは、この限りでない。

死亡の事実を知つた日が、この法律施行前であるときは、前項に規定する三年の期間は、この法律施行の日から起算する。
附 則
この法律は、公布の日から施行する。
